The Residency Requirements

Before you can file for a divorce in New York, you will have to meet the state’s residency requirements.

Below are the residency requirements in New York:

  • If one spouse lives in the state at the time of the filing, the spouse living in the state must meet a minimum 2-year residency requirements
  • If couple married in New York and one spouse is still a resident, there is a one-year residency requirement
  • If both spouses resided in the state and one is still a resident, there is a one-year residency requirement
  • If the spouses are both residents of the state and the grounds for divorce arose in the state, there is no minimum residency requirement

Fault or No-Fault Divorce

Every state in the country offers no-fault divorce, which means that if you wish to divorce your spouse, you do not need grounds for it other than “irretrievable breakdown” or “irreconcilable differences”. However, New York also allows spouses to file for divorce based on a variety of grounds.
